Services. The Photographer agrees to provide the photography services described in the selected package, proposal, invoice, or written scope of services. Additional coverage, locations, photographers, albums, prints, or other products must be agreed upon in writing and may result in additional fees.

Retainer & Reservation of Date. The booking payment is consideration for reserving the Photographer’s services for the contracted date and declining other work for that date. Except where otherwise required by applicable law or expressly stated in this Agreement, the booking payment is non-refundable.

Client Cancellation. If Client cancels the photography services, Client must provide written notice. Amounts already paid will be handled according to the cancellation terms of this Agreement and applicable law. If Client requests a date change, the Photographer may accommodate the new date if available, but a date change is not guaranteed.

Photographer Unavailability. If the Photographer must cancel because of serious illness, injury, emergency, or another circumstance that makes performance impossible or unsafe, the Photographer will make reasonable efforts to provide a qualified replacement acceptable to Client. If a suitable replacement cannot be secured, the Photographer’s liability will generally be limited to amounts actually paid for services not provided, except where applicable law requires otherwise.

Force Majeure. Neither party will be considered in breach for failure or delay caused by circumstances beyond reasonable control, including severe weather, natural disasters, government restrictions, venue closure, transportation disruption, serious illness, or other emergencies. The parties will work in good faith to reschedule or modify services when reasonably possible.

Client understands that wedding photography depends on reasonable cooperation from Client, the wedding party, guests, venue personnel, and other vendors. Delays caused by Client or third parties may reduce the amount of photography coverage available. The Photographer is not responsible for missed images resulting from delays, lack of cooperation, restricted access, venue rules, lighting conditions, weather, guest interference, or other circumstances outside the Photographer’s reasonable control.

Client acknowledges that they have reviewed the Photographer’s portfolio and are familiar with the Photographer’s documentary, intimate, and artistic approach. Client grants the Photographer reasonable creative discretion in photographing and editing the event. Requested “must-have” photographs will be accommodated when reasonably possible, but no specific image, pose, background, lighting condition, or photograph can be guaranteed.

The Photographer will deliver final edited images through an online gallery or another agreed delivery method. Delivery times are estimates and may vary. The Photographer will select the final images to be delivered. RAW files, unedited files, rejected images, test images, and working files are not included unless specifically stated in writing.

Final images will be edited in the Photographer’s established style. Basic adjustments may include exposure, color, contrast, cropping, and standard corrections. Extensive retouching, object removal, body reshaping, or other custom editing is not included unless agreed upon in writing.

The Photographer retains copyright in all photographs created under this Agreement. Client receives a non-exclusive, perpetual license to download, print, share, and display delivered images for personal, non-commercial purposes. Client may not sell the images, license them to third parties, use them for commercial advertising, or materially alter them without the Photographer’s written permission.

Client may choose whether the Photographer may use photographs from the wedding for portfolio, website, social media, advertising, editorial, competition, studio samples, and other promotional purposes.

Additional travel, lodging, parking, permits, tolls, or other pre-approved expenses are the responsibility of Client when stated in the invoice or proposal. For extended coverage, Client agrees to provide the Photographer and any contracted second photographer/assistant with a reasonable meal or meal break when required by the timeline.

Physical products such as albums, prints, canvases, and other artwork are subject to the pricing, design, approval, production, and delivery terms stated in the applicable invoice or product agreement.

The Photographer intends to maintain reasonable backups of delivered images but does not guarantee indefinite storage. Client is responsible for downloading and securely backing up delivered files.

The Photographer will perform services with reasonable professional care. In the event of loss, damage, corruption, or failure affecting photographs or services, the Photographer’s liability will generally be limited to the amount actually paid by Client for the affected photography services, except to the extent a different limitation is prohibited by applicable law.
